Nightclub Owner Wins Defamation Case vs. Police

Former superintendent Brett Guerin made comments to the Herald Sun and 3AW in 2014 about drug trafficking, overdoses and underage drinking at the Inflation NightClub.

Martha Tsamis, the director of Inflation Nightclub, sued the state over comments made by Guerin. "It was tarnishing my reputation. It was a betrayal and it was factually incorrect and a pure smear campaign," she said.

The state alleged truth as a defence. They claimed that Ms. Tsamis, indeed, operated the club in a way that jeopardised the health of patrons, resulting in hospital admissions. They also claimed that Guerin was merely expressing his opinion - a statement that cannot be a defamatory remark under the law. However, the court rejected these arguments. They ruled in favor of the plaintiff.

It’s the job of the police to find out whether there was drug trafficking, overdoses and underage drinking anywhere. In order to do it, they need to have concrete evidence, and file the appropriate charges in court. Comments accusing someone of crimes such as these ruin businesses and personal reputations - especially coming from law enforcement officers.
